These terms and conditions apply to any use of the eLabel platform (hereinafter the "Platform"), provided by eLabel (hereinafter the "Provider"). By creating an account, the customer (hereinafter the "User") accepts the following terms.
eLabel is a cloud-based Software-as-a-Service (SaaS) solution for managing, generating, and publishing digital product declarations, including ingredient lists, allergen scanning, nutritional values, certifications, and Nutri-Score calculations.
1.1. The Platform supports all official EU languages.
1.2. Certain features require a specific subscription plan. Some plans have limitations regarding the number of products (SKUs) and publications.
1.3. The Platform allows for generating and printing labels in various sizes.
1.4. The Provider reserves the right to continuously update, change, and improve the Platform's functionalities.
2.1. The User is responsible for providing accurate account information and keeping login credentials strictly confidential.
3.1. Prices are excl. VAT. Payments are accepted in DKK, Euro, or other relevant EU currencies.
3.2. Payment is made in advance for the selected period (monthly/annually) via credit card.
3.3. Automatic Renewal: Subscriptions renew automatically, and the payment is charged to the registered card unless cancelled before the end of the period.
3.4. Failed payments may lead to suspension of administrative access after 5 business days.
4.1. No Right of Withdrawal: As the Platform is a digital service provided exclusively for business users (B2B), there is no right of withdrawal once the subscription is active and the service has been accessed.
4.2. Termination: The User can cancel the subscription at any time effective at the end of the current billing period. No refunds are provided for already paid periods.
5.1. The User owns the rights to the data they enter. However, the Platform utilizes unique rights management based on EAN numbers.
5.2. EAN Ownership: The User who owns or has officially "claimed" an EAN number as the manufacturer/rightsholder holds the exclusive rights to edit the master data for that product.
5.3. Read Access: Other Users (e.g., importers) may access and generate previews of data based on the EAN number but cannot modify the original data established by the EAN owner.
5.4. 10-Year Storage: The Provider aims to keep public QR links active for up to 10 years to ensure retail validity.
5.5. Disclaimer: Continued hosting of data after subscription termination is a service the Provider strives to provide but is not guaranteed for non-paying users unless an archive-hosting agreement is in place.
6.1. The final responsibility for ensuring that label content complies with regulations rests solely with the User.
6.2. The Provider disclaims liability for indirect losses, loss of business, or loss of data.
6.3. The Provider's total liability shall never exceed the User's total payments for the subscription during the preceding 12 months.
7.1. The Provider may terminate the agreement immediately in the event of a material breach (e.g., hacking or illegal/irrelevant content).
7.2. The Provider has the right to use the User's logo as a reference unless the User has opted out in writing.
8.1. Any dispute shall be settled under Danish law at the Court of Odense.
